GENERAL CONDITIONS OF SALE (GTC)

THE OFFICE / THE ARTIST is a subsidiary managed by TOTAPLEX SAS (SIRET: 80051224600011, domiciled 43 Pierre Curie Street, 91240 Saint-Michel-sur-Orge, France)

OBJECT

The general conditions of sale apply to all orders for services concluded between the customer (hereinafter "the customer") and THE OFFICE / THE ARTIST or its managing company TOTAPLEX SAS (hereinafter "the studio"). Any service reservation entails full acceptance of these conditions, except for special conditions agreed in writing by the studio.

PRICES :

All prices are exclusive of tax (VAT) and are those heard when ordering the service.

SERVICE

RECORDING

The studio undertakes to implement all the means at its disposal to ensure the best possible capture of the sound source provided by the customer. The studio is not required to provide musical instruments and / or means of distribution thereof. The studio reserves the right to refuse to record any sound source which could, in its judgment, represent an infringement of intellectual property or be considered scandalous, obscene or offensive.

MIXING

The studio undertakes to implement all the means at its disposal to ensure the mixing of the title whose tracks have been provided by the client. Mixing is a step involving the subjectivity of the technician who performs it, the artistic quality of the latter can therefore only be judged subjectively. The tracks of the song must be provided by the customer in digital format either on USB stick or by internet transfer, the working versions provided by the studio will be sent via FTP or any other means of online transfer in mp3 format. The final high definition version will be provided via FTP or any other online transfer means after receipt of full payment. The studio does not authorize any public exploitation of the working versions provided. The studio reserves the right to refuse the mixing of any song whose tracks are, in its judgment, of too poor technical quality. The client also assures the studio that none of the tracks provided constitute an infringement of intellectual property or could be considered scandalous, obscene or offensive. If a complaint is lodged against the studio for one of these reasons, the client must compensate the studio for the damage suffered. The face-to-face mixing package at the studio includes one (1) mixing day per title (from 10 am to 18 pm), any additional day will be billed at the “Recording” rate.

MASTERING

The studio undertakes to implement all the means at its disposal to ensure the mastering of the title whose tracks have been provided by the client. Mastering is a step involving the subjectivity of the technician who performs it, the artistic quality of the latter can therefore only be judged subjectively. The tracks of the song must be provided by the customer in digital format either on USB stick or by internet transfer, the working versions provided by the studio will be sent via FTP or any other means of online transfer in mp3 format. TOUCH

Mixing and mastering services are offered as a package including either two remote retouch returns per song or a single face-to-face retouching session at the studio after the first version of the mixing / mastering has been presented. Any additional retouching that has not been addressed in the returns included in the package will be invoiced in addition. The price of additional alterations will be fixed in writing by the studio in advance depending on the time required for the latter to be carried out.

HOURS

The studio is open from Monday to Friday, from 9 hours to 19 hours (CET)

TERMINATION

RECORDING

Any recording session canceled less than 5 working days before the start of the session is due in full

MIXING

Any mixing service ordered by the customer is in full by the customer. The subjective quality of the mix can not be questioned.

MASTERING

Any mastering service ordered by the customer is in full by the customer. The subjective quality of mastering can not be questioned.

FORCE MAJEURE

An unforeseeable external event making it impossible to perform the service (accident in particular) is considered force majeure. Each of the parties may oppose this right when force majeure is characterized. In this regard, the studio reserves the right to cancel a service. Such cancellation can neither engage its responsibility, nor give rise to the payment of damages for any reason whatsoever. The studio or the client undertakes to notify the other party as soon as possible by telephone or email. The studio undertakes to find a replacement niche, and this at no additional cost for identical service. In the event of damage to the premises, THE OFFICE / THE ARTIST cannot be held responsible for the theft or damage to the material left by the client or for the destruction of files stored on the studio's hard drives. Under no circumstances can the contract be revoked and no refund, even partial, will be made.

OTHER

The studio is not required to keep digital files beyond 6 months after their creation. This document has been produced in accordance with French law. Any dispute can only be judged before a French court.
